Libozzle is an online classifieds platform in Libya, owned and operated by Modern Platform Company for Electronic Marketing Services, commercial registration no. 05010202412899. It lets individuals, stores and businesses list goods and services for sale or rent, such as cars, real estate, electronics, furniture and services, and lets buyers browse and contact sellers directly. Libozzle is not a party to any deal between them. “Libozzle”, “we” and “us” in these Terms mean Modern Platform Company for Electronic Marketing Services.

By using libozzle.com or the Libozzle app, you agree to these Terms and to the Privacy Policy published on the platform. If you do not agree, please do not use the platform.

1. Featured ads

Libozzle may offer “Featured Ads”, where users pay a non-refundable fee to show their ad in specific places on the platform and increase its visibility. You may be asked to provide information through a third-party payment provider subject to its own terms and policies. Libozzle does not guarantee the security of information sent to third-party providers, and dealing with them is at your own risk.

Paid featured ads are not currently available and will be enabled when wallet top-up is enabled under section 5.

2. Prohibited content and conduct

You agree not to post, upload or share any content on the platform that:

• Breaks the law: violates any law or regulation in force in Libya.
• Infringes intellectual property: is protected by third-party copyright, trademarks, patents or other rights, unless you own them or have the owner’s permission.
• Is harmful: is abusive, threatening, defamatory, obscene or pornographic, harms minors, invades others’ privacy, or promotes money laundering or gambling.
• Promotes hatred or discrimination: incites hatred against or demeans any person or group because of religion, origin, sex, age or disability.
• Is a discriminatory job ad: breaks local employment laws.
• Contains others’ personal data: includes personal or identifying information about another person without their explicit consent.
• Impersonates: pretends to be any person or entity, including Libozzle staff.
• Is misleading or fraudulent: contains false or misleading information or any form of fraud.
• Misdescribes the item: advertises an item you don’t own or aren’t authorised to sell, enters a price, condition, specification or category that doesn’t match the item, or uses a token price that isn’t the real price.
• Is unwanted marketing: network or pyramid marketing, chain messages, spam, or unsolicited commercial ads.
• Offers prohibited goods or services: illegal services or goods whose sale is banned under applicable law.
• Contains malware: viruses, programs or files designed to disrupt or damage systems or devices.
• Floods the service: sends excessive messages or requests that disrupt the service or harm other users.
• Hides its origin: uses forged email addresses or identifiers to disguise where content comes from.

You also agree not to:

• Contact anyone who asked not to be contacted, harass anyone, or contact users for commercial purposes unrelated to the ad.
• Post defamatory or false comments or ratings about anyone.
• Collect users’ data for commercial or unlawful purposes.
• Use bots or scraping tools to extract data from the platform, except general search engines (such as Google) and non-commercial archives that follow our robots.txt.
• Post the same ad more than once, in several categories or cities, or in an unsuitable category.
• Attempt unauthorised access to Libozzle’s systems or disrupt them.
• Use automated tools to report or post ads, or report competitors’ ads in bad faith.

If you break these Terms or the law, we may remove the content and suspend or ban your account, and the content may be investigated under applicable law.

3. Paid posts

Libozzle may charge fees to post content in certain sections or positions of the platform. Each poster remains responsible for their content and for complying with these Terms. Fees are not refunded if content is removed for breaking these Terms.

4. Ad review and publishing

Every ad is reviewed by the Libozzle team before it goes public, and we notify you of approval or rejection. Libozzle may reject any ad, ask for changes, move it to the right category, or stop it after publishing if it breaks these Terms or its details turn out to be wrong.

An ad is shown for the period of the selected package, then expires and stops appearing in search results; it can be renewed. Reviewing an ad does not mean Libozzle guarantees its accuracy or the seller’s ownership of the item; the seller alone is responsible for that.

5. Libozzle Wallet

The Libozzle Wallet is an internal system linked to the user’s account. Its balance currently consists only of points earned for posting ads, used for services Libozzle specifies. When top-up is enabled, registered users can buy credit for Libozzle services.

• Credit and points cannot be exchanged for money, earn no interest, are non-refundable and cannot be transferred to another user.
• The wallet can be used only for Libozzle’s services, not to buy goods or services offered by other users.
• Top-ups are final; any fees set by the payment provider are shown before you confirm.
• Purchased credit expires one year after purchase if unused.
• All balance is lost when an account is deleted or terminated; we show you the balance before you confirm deletion.
• Libozzle may stop selling credit or change its price and use, and may confiscate any credit obtained fraudulently.
• Wallet disputes must be reported within seven (7) days of discovery; after that the wallet record is deemed correct.

6. Business accounts and posting for others

Stores and businesses may post ads for goods and services they own or are authorised to sell, after registering a business account and Libozzle approving it. Otherwise, posting on behalf of others, directly or indirectly, is not allowed without Libozzle’s written consent.

7. Licence and intellectual property

Libozzle grants you a limited, revocable, non-exclusive licence to use the platform for personal purposes, or, for business account holders, to list their business’s goods and services. This licence does not cover copying, compiling or republishing the platform or its content, or using automated tools to extract data, without Libozzle’s express permission.

You may link to an ad or the home page from your site or accounts for non-commercial purposes, as long as the link does not misrepresent or harm Libozzle.

All intellectual property in the platform, including the Libozzle name and logo, the design, software and content of the website and app, except what users post, belongs to Modern Platform Company for Electronic Marketing Services and may not be copied or used without prior written permission.

By posting content on the platform, you give Libozzle a non-exclusive licence to display, format and promote it on the platform and in its marketing for as long as it is published.

8. Reporting infringement

Libozzle is not responsible for intellectual property infringement arising from content posted by users. If you own a right, or are authorised to act for its owner, and believe content on the platform infringes it, send us a good-faith notice that includes:

1. Your signature or that of the person authorised to act for the right holder.

2. Identification of the right claimed to be infringed.

3. The link or number of the ad.

4. Your contact details: name, phone and email.

5. A statement that you believe in good faith the use is not authorised by the owner or the law.

6. A statement that the information is accurate and that you are authorised to act for the right holder.

Send notices to support@libozzle.com or through in-app support. Our cooperation is not an admission of liability. Please also report any ad that breaks these Terms.

9. Spam and abuse monitoring

Sending unsolicited messages to users through the platform or its systems is prohibited. You acknowledge that Libozzle may use human review or automated tools to detect words associated with fraud or spam, in the cases set out in the Privacy Policy. Any unauthorised use of Libozzle’s systems may expose the person to civil and criminal liability.

10. Dealings between users

Libozzle is only an advertising intermediary. It is not a party to any sale, purchase or rental between users and is not responsible for payment, delivery, the item’s condition, the validity of its documents, or any guarantees between the parties. We recommend inspecting and checking an item before paying anything, and not sending any deposit before that.

Any deal is solely between you and the other party. Libozzle is not liable for any loss or damage arising from it and is not obliged to get involved in any dispute. If you have a dispute with another user, you release Libozzle, its staff and agents from any claims arising from it, to the extent permitted by law.

11. Limits and termination

Libozzle may set limits on use of the platform, such as the number of ads, photos or messages, or how long content is kept, and may change or stop the service in whole or in part, with or without notice.

Libozzle may, at its discretion, suspend or delete your account, block your email or IP address, and remove any content if it believes you have broken these Terms. You agree not to try to use the platform after your account is terminated.

12. Disclaimer of warranties

The platform is provided “as is” and “as available”, without any express or implied warranties, to the fullest extent permitted by law. Libozzle does not guarantee the accuracy or completeness of ads or of linked external sites, and is not responsible for:

1. Errors or inaccuracies in content.

2. Any personal injury or property damage resulting from your use of the platform.

3. Unauthorised access to our servers despite reasonable security measures.

4. Interruption or suspension of the service.

5. Viruses or malware transmitted by a third party.

6. Any loss resulting from use of content or messages available through the platform.

13. Limitation of liability

Libozzle and its officers, staff and agents are not liable for any direct, indirect or consequential damages arising from using, being unable to use, changing or stopping the platform, from any advertised goods or services, or from the conduct of any user or third party, to the fullest extent permitted by Libyan law.

14. Assignment

You may not transfer these Terms or any rights under them to anyone else. Libozzle may transfer them without restriction, for example in a merger or sale of the company.

15. Eligibility

Libozzle is intended for people aged 12 and over. Users under 18 may use it only with a parent’s or guardian’s consent and supervision; we may ask for proof of that consent and suspend the account until it is provided. If you are under 12, you may not create an account or post ads; if we find out, we will delete the account and its data.

If you use the platform on behalf of a person or entity, you confirm you are legally authorised to represent them.

16. Personal data and marketing

Your data is collected and used under the Privacy Policy published on the platform, which forms part of these Terms. By creating an account, you agree to the use of your data to market Libozzle’s services, including promotional messages to your phone and email and paid ads on other platforms; you can stop promotional messages as explained in the Privacy Policy.

The contact number you add to your ad is shown to registered users. No user may use sellers’ numbers or data for anything other than contacting them about that ad.

17. Governing law and general terms

These Terms, the Privacy Policy and the other policies published on the platform form the entire agreement between you and Libozzle and replace any earlier agreement. They are governed by the laws of Libya, and the Tripoli Court of First Instance has exclusive jurisdiction over any dispute arising from them.

If any provision is found invalid or unenforceable, the rest remain in force. Libozzle’s failure to exercise a right is not a waiver of it, and Libozzle may seek compensation and court orders against any breach of these Terms.

Libozzle may update these Terms from time to time. The last-updated date appears at the top of the page, and we will notify you of significant changes in the app or by email before they take effect. The Arabic version is the official version and prevails over this English translation in case of any difference.

18. Deleting your account

You can delete your account at any time in the app or on the website: sign in, then Profile → Settings → Delete account, and confirm after reading the warning. Or write to us at privacy@libozzle.com from the email registered on your account.

Deleting your account deletes your profile, ads and chats, and any wallet balance is lost without compensation under section 5. This cannot be undone, and Libozzle keeps some records for the periods set out in the Privacy Policy.
